some one as told me if you have a spare tyer and it as never been used,and is 5years or more you cant fit it to the car

Never heard of that before and my old man was a mechanic. I would say however, that if it's a spare that is mounted on the exterior of the vehicle, like many 4x4's AND it's continually left in direct sunlight, then I would lean towards agreement on a "5 year rule". The rubber needs to "move" to keep it elastic, otherwise it will "dry out" and start to perish.

Bizarrely, I have to add an update to my previous post. Now, I have NEVER had this happen to me, but low and behold, this afternoon, one of the tyres on my trailer just exploded Fortunately it wasn't in use at the time, but there you go, confirmation that too much direct sunlight on an infrequently moved tyre can cause a blow out. Completely out of the blue.
