Can anyone tell me whether there is a general law or code of practice in Spain whereby properties are sold to included furniture unless otherwise stated?

The choice is entirely up to you, what is possibly better for both parties is to price it without but then offer them a furniture package at a fair price that way the buyers get the choice and pay less tax on the purchase .

Thanks for your advice Cavern. Just to explain why I asked the question; we have sold our property with no formal agreement for all the furniture to be included in the sale but at the time of the offer, prior to the deposit being paid, we indicated that some of the furniture would be included. Having now sold off various items, the purchaser is trying to stipulate that there was a verbal agreement to sell the property fully furnished. None of this was included or itemised in the initial agreement when the contract and deposit was paid so I needed to be sure that we were not in breach of any law or code of practice even if it wasn't stipulated in the contract. I am pleased to hear that we are within our rights in what we have done and as we are also leaving a good number of pieces of furniture do not feel morally obligated or guilty about it either.

I'm not a a lawyer so I maybe wrong but we had much the same when we sold in Portugal , they said they thought it included all the furniture that had never once been discussed and we certainly didn't ever have that in mind. We stuck to our guns and said no if you want that it will be an extra ??? actually it was an absolute bargain price but they declined.

When we bought here part of the deal was the furniture but we paid seperately for it as nobody wants it added to the purchase price as both parties will pay tax on it . So I now suggest you write up a list for what you are leaving and put a seperate price to it but be careful remember they might then decline it and it will have come off the purchase price.

You are not obliged to leave any furniture for the new owners, unless it has been included in the buying contract.
You could ask he buyer if they want anything you are selling, but this would be under separate negotiation. When we purchased our house in Spain NOTHING was left by the sellers...........they even removed the light bulbs.

Thanks for your replies. We have now told the purchaser that they should have specified which furniture they wanted at the outset and then we would have drawn up an inventory and negotiated a separate price.

We haven't heard anything back yet ... hopefully, when we do, we can stop stressing!
