As you may or may not know, new laws are currently in force since the end of July 2012, for residency in Spain for more than three months.
I have read the law in English and seems pretty straightforward, albeit a pain to go through. It stipulates that the applicant has to provided evidence of private or public healthcare to cover use in Spain, plus you have to demonstrate that you have sufficient income to keep you out of claiming other social security benefits in Spain.
There is no figure quoted in the law, but I have gathered that it needs to be enough to keep you out of claiming any Spanish benefits.
I have social security numbers and a health card, so I guess I am ok there. Has anyone else heard of any figures quoted on what is perceived to be "sufficient monthly means" to comply with this requirement.
Obviously this is a revenue gathering exercise to bring in funds to the government, by taking money for the new residency cards etc., plus getting rid of unwanted residents.
Would be interested in other folks views. But I guess everyone will be ok if they officially leave Spain within every period of three months.
But the law states that everyone who comes to Spain now to live has to register for the new card within three months of entry.
I guess like every new Spanish law it will take time to filter through. But I have already heard of of a Romanian who has been sent packing when he finishes his current tomato picking job! I pass this post to the arena of comment.

On 10 July 2012 the Spanish Government introduced details of the new residency requirements for all EU citizens, including British nationals.
Under the new rules, EU citizens applying for residency in Spain may be required to produce evidence of sufficient financial means to support themselves (and dependants). Applicants may also be asked for proof of private or public healthcare insurance.

The Ministerial Order sets out the new residency requirements and some of the documentation applicants may be asked to present. We have created an unofficial translation of the Ministerial Order.

Please note: This translation is provided by the British Embassy with the intention of assisting English-speaking EU citizens to understand the new residency requirements. The British Embassy can take no responsibility for any errors or differences between this and any future official translation, nor for any inconvenience or expense caused by any error or difference


All EU citizens planning to reside in Spain continue to need to register in person at the Oficina de Extranjeros (Foreigners Office) in their province of residence or at designated Police stations. More information is available on the Ministry of the Interior’s website.

I think this is a good idea, and when I arrived in Spain before the eu it was also expected.
It would go some way to deterring people with no financial means of support staying away.
This is part of Spains problem as their is a huge workforce working illegally.

If it helps, we are watching the process closely as we are planning to 'go for it' next year. It comes down to (as I see it, and bounce me if you disagree):

If you are of retirement age, your S1 form will be adequate to show you have medical cover , and you have to prove an income of approx 440 euros per month. The whole ethos revolves around one NOT being a 'burden oin the state'. If NOT of retirement age (like us), you have to have Medical cover for 'all risks' ( Comprehensive cover I assume) and the aforementioned 440 euros income per person. APPARENTLY the 440 euros is the minimum to take you out of the benefits system, and thats why its set at that level. Again, the 'burden on the state is the reasoning. The medical Insurance aspect is a bit of lottery, and needs careful research, but initial stuff that we have done suggests cover obtained in Spain is cheaper/better value for money than 'International' cover you may negotiate in the UK.

Obviously if working, you have to produce your Contract / Tax arrangements etc.to get NHS cover for whiloe you are in Spain, and if self employed Health (NHS) cover is part of the 250 euros 'Autonomo' you have to give every month.

I know we always have the EHIC card, but thats for EMERGENCIES only and could land you in the schmoo if you need treatment/after care subsequent to the 'emergency' action. We are currently looking at Medical Insurance to cover Spain full time and the UK as travellers up to 30 days for when we hop back to see the Grandkids etc.

Obviously, peoples needs will differ, and if you have an 'existing condition' it complicates things, no doubt of that!Also, taking excesses reduces the Policy, and there are hundreds of combinations on the market.

Anyway, tin hat on, would welcome your views and any experience/advice regarding Private health cover in Spain and if I am right to say it appears cheaper to sort it in Spain.

As you rightly state, "International" cover taken out in the UK could be more expensive than cover taken out in Spain but I would say that is more because of the amount of territory that was being covered by the policy in question. I would add that it would be best to check when taking out a medical policy in Spain to make sure how far the cover would go. We went to take out medical insurance in Spain to cover the 2 years before we became pensioners. When we enquired we were given a good quote but happened to mention that we were due to move to a different region of Spain. We were immediately told that the price would be much more as the original quote was only to cover us for the region we were in so to cover us for when we were elsewhere in Spain would mean the insurance company would want more to cover the whole country (possibly due to having to transfer you back to your own region if taken ill). We waited until we had moved to the new region and took out insurance there. Needless to say this was 8 years ago but I thought it worth mentioning in case things are still the same.

No, you are still entirely right on that one. Obviously, the 'International' cover makes no difference as regards where you are in Spain or the EU for that matter, but as you said we always got asked the location of our house when trying to arrange 'local' cover, and in fact some Companies didn't give cover in the area at all!
Decided that when we are 'over' next month, we will look at the whole thing again.

why wait until you are a pensioner???
Get a letter from the DWP stating that you no longer receive health care from the UK because you are resident in Spain, then sign up with a local GP and get your green health card for you prescriptions etc.
Was it that simple or did I miss something.

We tried this, as we had been advised by a well meaning, but mis informed person, that we would be able to pay into the Spanish system..We were told that once the ''NHS.UK'' 2 years had expired, the only way to access and pay into the Spanish health system was to be self-employed. We had budgeted for the payment, but were not able to pay it!

Private health care, with pre-existing medical conditions declared, was at the time, extortionate.

It only works if you fulfil the criteria below,

If you live in Spain but aren't working and have not yet reached retirement age, you may still be able to get free or low cost state healthcare for a limited period of time, depending on your circumstances. If you've been paying social security contributions in the UK fully and for the 2yrs up to the point of departure, you can apply for form E106 from DWP in the UK. They will send you a claim pack and let you know whether you're entitled to a form of limited cover. Ask if you can include any family members in your claim. If they decide you're entitled to claim, they'll send you form E106 which you must then complete and register with the social security authorities in Spain.

If you are registered on the Spanish System make sure you also get a Spanish EHIC as your UK one will be voided by virtue of being resident elsewhere.

Thanks, all. Pobo, I don't think that can be done anymore to be honest. The DWP Cert thing is still available, and lasts for two years of NHS cover in Spain, but apparantly this is being frowned on by the Spanish Authorities, as the guy in Baza that issued my NIE stated that the UK were not paying up for ex pats treatment. his words, not mine!!!!! Thankfully, its not his call BUT the implication was that the door will be closed on this soon.

Also, at 55 this will leave quite a gap until we can go into the 'retirees' system at 66. Anything that happens during the 2 years could become 'pre existing' for the private cover we would then need at age 57, as we have 'nothing to declare' as of now, could cause a problem/ increased premium.

I just wonder how the 'early retirees' ex pats are handling all this?

If you are pensioners the EHIC card now has to be obtained from the UK. The rule was changed in 2010. It is issued by the DWP and lasts for 5 years. Although issued by the UK it is not for use in Spain but is needed if we are in the UK. Cannot say for those not pensioners as we were already at that stage when the rules changed. Possible, if you are self-employed and paying into the Spanish system, you may still get the EHIC from Spanish Social Security as we used to do but I do not know the answer to that one. In some ways the UK EHIC card is better as it lasts for 5 years whereas the Spanish one we had only lasted for 1 year.
